New York, NY, May 20, 2015 –(PR.com)– Attorney Michael J. Redenburg has been retained to represent an individual against the City of New York in a federal lawsuit for wrongful arrest. In Eastern District of New York Case Number 15-cv-2155, the complaint demands a trial by jury and includes causes of action for false arrest, unlawful search and seizure, failure to intervene and a Monell Claim.
According to the complaint, plaintiff was using an ATM at a store in Brooklyn around noon on April 7, 2015, when two NYPD officers grabbed him and started searching him without probable cause. The officers asked for identification, and he produced it. Back-up officers were called to the scene, and plaintiff claims one officer began teasing him about his sneakers saying they were fake. Another officer allegedly told plaintiff he was going to the precinct because the officer felt like putting him through the system.
Plaintiff was handcuffed and taken to the 70th Precinct, where he waited approximately nine hours before being taken to Central Booking to await arraignment. The charges against plaintiff included disorderly conduct, obstructing governmental administration and a health code violation. The matter was adjourned in contemplation of dismissal.
As a result of his 22-hour detention, plaintiff asserts that he suffered an unlawful detention, loss of liberty and emotional distress. He is seeking compensatory and punitive damages as well as attorneys’ fees and costs.
